Returns/Restocking Fee/Additional fees
All returns must be expressly authorized by
Cubiclemart
within 30 days of order placement.
We will accept for return, with in 30 days of
order receipt, only new, standard stock,
non-defective, unused, in warranty and
originally packaged products for full credit.
Any returns received under 30 days that are
returned used, have missing packaging, missing
parts and instructions or cannot be re-sold as
new will be assessed with a 20% re-stocking
fee and store credit will be issued to your
account for future use. The above does not
apply to any used office furniture which is
sold "as is" and no returns will be accepted.
Any returns received after 30 days will
receive store credit. If item is returned
used, have missing packaging, missing parts
and instructions or cannot be re-sold as new
will be assessed with a 50% re-stocking fee
deducted from store credit issued. Any product
that is returned, that cannot be resold due to
condition or any other reason, will not
receive any credit at all. The above does not
apply to any used office furniture which is
sold "as is" and no returns will be accepted.
ALL DAMAGE CLAIMS AND MISSING PARTS MUST BE
REPORTED WITHIN 48 HOURS OF RECEIPT OR CLAIMS
WILL NOT BE HONORED.
Shipping charges will not be refunded, unless
an error was made by the
Cubiclemart
in
shipping. Before returning an item, you must
have an RMA number. Please call or email us to
get an RMA #. Shipping charges are
non-refundable.
To return a product to
Cubiclemart
you
must obtain a Return Merchandise Authorization
("RMA") number within 30 days.
Cubiclemart
will
not accept returns without prior authorization
and a RMA number. Once issued, RMA numbers are
valid for 15 days within which return products
must be received by the
Cubiclemart
RMA numbers will not be extended or reissued.
Customer should prominently display the RMA
number(s) on the shipping label of boxes
containing the returned product.
Customer is solely responsible for shipping
any returned product to
Cubiclemart
Customer agrees to use only reputable carriers
capable of providing proof of delivery and
insurance for the entire value of the
shipment. Customer agrees to bear all shipping
charges and all risk of loss for the return
product during shipment. Customer agrees that
all returned products will be 100% complete,
in re-saleable condition, and will include the
original packaging material, manuals, blank
warranty cards, and other accessories provided
by the manufacturer. If any component of the
returned product is missing, If

Return policy is breached,
Cubiclemart
will reject the entire return or may choose to
impose additional charges against the customer
for replacement of the missing component.
Cubiclemart
will not refund to Customer the original
shipping charges. In addition,
Cubiclemart
reserves the right to charge a restocking fee
on end of life and special order products.
Refused
or Undeliverable Packages and Shipments
Sometimes, a carrier will be unable to deliver
a package to the address provided to them.
This can happen if the address provided is
incorrect, or if the person receiving that
shipment at that address refuses it. If this
happens, the package will be returned to

We will provide a refund to the buyer for the
item, less a 20% restocking fee and the
shipping charges incurred by Creative Energy
Technologies Inc's (The cost of shipping the
package to you and back to us) or the customer
will provide a new shipping address and we
will reconsign the order. The additional
shipping cost due to the reconsignment will be
billed to the customer. This policy applies to
all products, including items that are
featured with free shipping promotions.
Processing Time
You can expect your order to be processed
within approximately five to ten "business"
days, provided the items are in stock and
there are no problems with the payment
verification unless their are any
modifications or additional outsourced parts
or products need to make the customers order
complete require additional business days in
order to process the customers order..

Orders
Any items that are unavailable will be placed
on back order. You will be contacted of the
back order status via email. We try to ship
complete to keep shipping costs down.
Additional shipping costs will be added to
your order when split shipping.

you ("The Customer") agree to be bound by the

and Cubiclemart

the exclusive terms governing the sales
transaction between Customer and

attempt to alter, supplement, modify or amend
these terms and conditions by the Customer
will be considered a material alteration of
this agreement and, therefore, are null and
void. In addition, these terms and conditions
are subject to change at any time, without
prior written notice. Therefore, please check
these terms and conditions carefully each time
you place an order with or accept delivery of

WARRANTIES
Cubiclemart is
a dealer/distributor only. The products may,
however, be covered by each manufacturer's
warranty, service, and support policy (if
any).
Cubiclemart
assigns and passes through to the Customer any
warranty of the manufacturer, and Customer
acknowledges that it shall have recourse only
under such warranties and only as against the
manufacturer of the products. Cubiclemart MAKES
NO REPRESENTATION OR EXPRESS WARRANTY WITH
RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN
THIS DOCUMENT.
Cubiclemart DISCLAIMS
ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS
TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT
LIMITATION, THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE, AND ANY IMPLIED WARRANTIES ARISING
FROM STATUTE, TRADE USAGE, COURSE OF DEALING,
OR COURSE OF PERFORMANCE.

LIMITATION OF LIABILITY
IN ALL CIRCUMSTANCES
Cubiclemart
MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE
PRICE OF THE PRODUCTS SOLD.
Cubiclemart
SHALL
NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A
CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY
OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO
THE PRODUCTS IT SELLS WHICH EXCEEDS THIS
LIABILITY LIMIT.

SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR
DAMAGES AGAINST THE CUSTOMER, OR FOR
MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE,
LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY
DAMAGES, WHETHER OR NOT
Cubiclemart
IS
APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR
DAMAGES.

GENERAL TERMS AND CONDITIONS
Payment Terms Orders: An order is not binding
upon
Cubiclemart
until it is accepted;
Cubiclemart
must
receive payment before it will accept an
order. Payment for product(s) ordered is due
prior to shipment. Customer can make payment
with a company business check, or some other
method prearranged with Creative Energy
Technologies Inc . You agree to pay the
amount(s) due as specified on the invoice, and
you agree to pay interest on all past-due sums
at a rate of 1.5% per month or the highest
rate allowed by law, whichever is greater.
Shipping Charges: Your total cost for purchase
of any product will include shipping and
handling charges shown on the
Cubiclemart
invoice.
Title & Risk of Loss:
Cubiclemart
will
arrange for shipment of ordered product(s) to
the Customer, Free On Board (F.O.B.) shipping
point, meaning title to the product(s) and
risk of loss passes to the Customer upon
delivery to the carrier. Cubiclemart
reserves a purchase money security interest in
the product(s) until its receipt of the full
amount due.
Cubiclemart
will advise Customer of estimated shipping
dates, but
Cubiclemart
will,
under no circumstances, be responsible for
delays in delivery, and associated damages,
due to events beyond its reasonable control,
including without limitation, acts of God or
public enemy, acts of federal, state or local
government, fire, floods, civil disobedience,
strikes, lockouts, and freight embargoes.
Governing Law and Jurisdiction: Any dispute
arising out of or related to these Terms and
Conditions or the sales transaction between
Cubiclemart
and Customer shall
be governed by the laws of the State of Texas,
without regard to its conflicts of law rules.
Specifically, the validity, interpretation,
and performance of this agreement shall not be
governed by the United Nations Convention on
the International Sale of Goods.
Cubiclemart
and
Customer consent to the exclusive jurisdiction
and the venue of the State Courts of the State
of Texas, Wise County, to resolve any dispute
between them related hereto, and the parities
waive all rights to contest this exclusive
jurisdiction and venue of such Courts.
Finally, the Customer also agree not to bring
any legal action, based upon any legal theory
including contract, tort, equity or otherwise,
against
Cubiclemart
that is more
than one year after the date of the applicable
invoice.
Severability: If any provision contained in
this agreement is or becomes invalid, illegal,
or unenforceable in whole or in part, such
invalidity, illegality, or unenforceability
shall not affect the remaining provisions and
portions of this agreement, and the invalid,
illegal, or unenforceable provision shall be
deemed modified so as to have the most similar
result that is valid and enforceable under
applicable Texas law.
Waiver: The failure of either party to require
performance by the other party of any
provision of this agreement shall not affect
in any way the first party's right to require
such performance at any time thereafter. Any
waiver by either party of a breach of any
provision in this agreement shall not be taken
or held by the other party to be a continuing
waiver of that provision unless such waiver is
made in writing.
Entire Agreement: These terms and conditions,
together with the
Cubiclemart
invoice respecting the products ordered by
Customer, are the complete and exclusive
agreement between
Cubiclemart
and Customer, and they supersede all prior or
contemporaneous proposals, oral or written,
understandings, representations, conditions,
warranties, and all other communications
between
Cubiclemart
and Customer relating to the subject products.
This agreement may not be explained or
supplemented by any prior course of dealings
or trade by custom or usage.
Illegal Activity, Fraud or Non-Payment for
Merchandise:
In the event of any illegal activity on the
Cubiclemart,
we reserve the right to turn over the
information collected to the appropriate
authorities, lawyers and credit collection
personnel. This includes attempts to hack into
or otherwise compromise
Cubiclemart.
Also included is any fraudulent use of credit
cards, checks, money orders or wire transfers.
Cubiclemart
reserves the right to use all legal means to
recover payment for any orders shipped. This
includes non-payment as a result of credit
card chargeback or disputes, and checks with
insufficient funds or stop payment.
